Right of Way Agent prepares organization's need for additional land or office space. Researches, negotiates and elects to purchase short- and long-term lease of land agreements and right of way for construction that meet the organization's goals. Being a Right of Way Agent handles all land related legal issues, including transfers of titles and deeds, construction, mortgage concerns, and zoning. Prepares resolutions and other legal forms related to land acquisitions. Additionally, Right of Way Agent may require a bachelor's degree. Typically reports to a supervisor or manager. The Right of Way Agent contributes to moderately complex aspects of a project. Work is generally independent and collaborative in nature.     The Idaho Transportation Department currently has an opening for a Right-of-Way Agent. This position is located in Shoshone and will report to the District Engineer. The purpose of this position is to administer Right-of-Way activities including negotiation and relocation functions. Incumbent will participate in all aspects of the right-of-way property acquisition process as well as property management. The successful applicant must demonstrate professionalism and excellent customer service.

    Occasionaltravel with overnight stay and irregular working schedules are required. Requires valid driver's license.

    Example of Duties

    • Researches public records and other sources to obtain data;
    • Prepares legal documents, contracts, agreements, exhibits, and reports;
    • Review and/or approves legal descriptions;
    • Verifies platting of ownership limits on plans;
    • Reviews project alignments and determines extent and quality of titles;
    • Reviews final title reports for land parcels, and determines legal instruments required to release property and obtain clear title;
    • Verifies completeness of legal instruments, exhibits, plans, and papers for land acquisition;
    • Obtains market data;
    • Analyzes area economic conditions, lending practices and real estate trends;
    • Assembles comparables and correlates factors affecting property values and prepares estimate of fair market value;
    • Meets with property owners to review project plans, explain appraisal process and negotiate purchase agreements;
    • Makes relocation studies to determine number of displacements, availability of replacement property, moving and replacement costs and time required for relocation;
    • Prepares relocation plans, meets with displaces to explain relocation entitlements, eligibility and assistance;
    • Participate in scoping to identify potential right-of-way impacts, represent property owner concerns, and inform project teams about delivery timelines and potential costs during project development.
    • Inspects and manages department properties to insure compliance with agreements through final disposition;
    • Reviews plans and deeds to verify property location, highway stations and proposed encroachments do not interfere with existing facilities or access control policies;
    • Makes inspections to verify and evaluate advertising signs and junkyard and enforce standards and compliance with scenic enhancements programs and laws;
    • Negotiates for the screening or elimination of junkyards and removal of nonconforming signs.

    Administrative. Typical responsibilities: updates database system and produces project reports; responds to right-of-way inquiries; represents the department in public hearings and meetings; may serve as in expert witness in court; provides technical assistance and serves as liaison with federal, state, and local agencies; special interest groups, real estate organizations, property owners and the public.

    Minimum Qualifications

    Good Knowledge of:

    • Appraisal principles and practices; legal descriptions, documents and instruments used to transfer property.

    Experience

    • Preparing legal descriptions of real property; determining clear title; estimating fair market value and preparing formal appraisal reports; negotiating property settlements; manipulating data base software to store, retrieve and compile information into report format.
