Under a recent California Supreme Court case, third-party agencies who do recruiting, background checks, and provide other services related to hiring and employment can be directly liable to candidates for their discriminatory actions. Here's more on the Raines case and some approaches to deal with it.

As states continue to regulate the use of AI in employment decisions and allocate liability by statute, both employers and HR Tech companies will need to better educate the people making the decisions on what the tech can and cannot tell you, what else to consider, and how to question and pressure test the tech insights.
HR Tech providers are probably going to be liable for products that have discriminatory results. The California Supreme Court just laid the foundation for the claims.
